TALK Research – Terms and Conditions for Online Professional Development Courses.

These Terms and Conditions (“Terms”) govern your registration and participation in any online professional development course (“Course”) provided by TALK Research (“we,” “us,” “our”). By enrolling in or accessing a Course, you agree to be bound by these Terms.
1. Purpose of the Course
1.1 The Course provides general professional development training in clinical communication for psychologists and related mental-health practitioners.
1.2 The Course does not constitute clinical supervision, therapeutic advice, or treatment recommendations.
1.3 Completion of the Course does not grant accreditation, endorsement, or competency validation under the Health Practitioner Regulation National Law (as in force in each state and territory).
2. Eligibility
2.1 Participants must hold relevant psychological or mental-health qualifications or be enrolled in an accredited training program.
2.2 Participants must ensure compliance with relevant professional bodies, including the Psychology Board of Australia (PsyBA) and Australian Psychological Society (APS).
3. Enrolment, Access, and Payment
3.1 Access is granted upon successful registration and payment of all required fees.
3.2 Access credentials (passwords, links) must not be shared or transferred.
3.3 Refunds: Nothing in these Terms limits your rights under the Australian Consumer Law (ACL). Remedies required under the ACL (refund, replacement, or compensation for major failures) will be honoured.
4. Participant Responsibilities
4.1 You are solely responsible for applying Course content in your own professional context.
4.2 You must comply with ethical and legal obligations relevant to your practice, including the APS Code of Ethics and PsyBA guidelines.
4.3 You must not record, distribute, or modify Course materials without written permission.
5. Intellectual Property
5.1 All Course materials are the intellectual property of TALK Research or licensed third parties.
5.2 You are granted a limited, non-transferable license for personal professional development use.
6. No Clinical Advice or Liability
6.1 The Course is educational only and is not clinical training, supervision, or case consultation.
6.2 TALK Research is not liable for:
clinical decisions made by participants,
application or misapplication of Course content,
any adverse outcomes arising from practice or client interactions.
6.3 Participants retain full professional responsibility for all clinical decisions and conduct.
7. Disclaimer of Warranties (Subject to ACL)
7.1 Except for non-excludable guarantees under the ACL, the Course is provided “as is” without warranties.
7.2 TALK Research does not guarantee uninterrupted access or that the Course will meet specific professional needs.
8. Limitation of Liability (Subject to ACL)
8.1 Nothing excludes consumer rights guaranteed under the ACL.
8.2 Where permitted by law, TALK Research’s liability is limited to:
re-supply of the Course, or
payment of the cost of re-supply.
8.3 TALK Research is not liable for indirect, special, or consequential losses.
9. Privacy and Data Protection
9.1 TALK Research complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
9.2 Personal information is collected for registration, participation, communication, and evaluation.
9.3 Participants must safeguard their login credentials.
10. Course Modifications
10.1 TALK Research may modify Course content, schedule, or trainers without prior notice.
10.2 Significant changes will be communicated where practicable.
11. Termination of Access
11.1 TALK Research may revoke access for violations of these Terms or disruptive/unsafe conduct.
11.2 No refunds will be provided if access is revoked due to participant misconduct (subject to ACL rights).
12. Governing Law and Dispute Resolution
12.1 These Terms are governed by the laws of [Insert State/Territory], Australia.
12.2 Parties agree to attempt good-faith negotiation before pursuing formal dispute resolution.
12.3 If unresolved, disputes may proceed to mediation through the Australian Disputes Centre (ADC).
12.4 Court proceedings may only commence after mediation, unless urgent injunctive relief is required.
13. APS & PsyBA CPD Requirements
13.1 CPD Eligibility:
Courses may be suitable for CPD hours under the Australian Psychological Society (APS) and Psychology Board of Australia (PsyBA) frameworks. Acceptance cannot be guaranteed by TALK Research.
13.2 Participant Responsibility:
You are responsible for ensuring the Course aligns with your professional development goals and APS/PsyBA requirements.
13.3 Self-Assessment:
APS members are required to self-assess relevance to their scope of practice. TALK Research does not assess your CPD suitability.
13.4 Documentation:
TALK Research will, where applicable, provide:
a certificate of completion,
learning objectives,
trainer credentials, and
Course duration.
You must retain CPD evidence for the period required by APS/PsyBA (typically five years).
13.5 Active Learning:
If the Course includes interactive elements, it may contribute to Active CPD, but classification decisions remain the participant’s responsibility.
13.6 No Guarantee of Approval:
TALK Research does not guarantee APS endorsement or suitability for specialist endorsement pathways.
13.7 Audit Compliance:
You are solely responsible for compliance during APS or AHPRA audits.
14. Acceptance of Terms
By registering for the Course, you confirm you have read, understood, and agree to all Terms, including APS/PsyBA CPD obligations and your rights under the Australian Consumer Law.
